As stipulated in our Terms & Conditions, Shyft’s services are intended for the general public and therefore, this Privacy Policy applies to all users, including those that use our services without registration.

Shyft collects, uses, and discloses personal data relating to customers and clients for the purposes of developing and managing processes and technologies for recording video surveys of household goods, preparing household goods’ inventories, communicating pricing and other useful information between people who need to move and moving industry service providers and facilitating the ‘booking’ of various services by such people with such service providers. If you provide personal data to us, either directly or through a reseller or other business partner, we will use or disclose your personal data for the following purposes:
We may provide your personal data only to contracted third parties for surveying and execution of your move. Shyft has responsibility for the processing of personal information it receives under the Privacy Shield and subsequently transfers to a third party acting as an agent on its behalf. Shyft shall remain liable under the Privacy Shield Principles if its agent processes such personal information in a manner inconsistent with the Principles, unless Shyft proves that it is not responsible for the event giving rise to the damage.
Depending on the purpose of use of your personal data, there can be following legal basis for processing of your personal data:
Your personal data can be processed for specified and legitimate purposes only, as stated in section III of this Privacy Policy, and Shyft may retain it for the duration of the completion of such purposes. If there is a need to comply with legal requirements, we will be obliged to keep your personal data beyond the expiration of designated purposes.
As explained in section VI of this Privacy Policy, persons to whom personal data pertain may request deletion of some of their data at any time. Not all data can be immediately deleted pursuant to such a request, because its retention may be necessary for the provision of contracted services or the preservation of business relationships.
Some data we delete automatically after a specific period of time, while some are converted and preserved in anonymized form. When you request erasure of your data, we follow a strict deletion policy to make sure that your data is safely and completely removed from our servers, or retained only in anonymized form. We may need anonymized data for different business intelligence matters, such as analytics and statistical purposes, as mentioned in section III.

All data on our web site and services, including your personal data, is stored on Amazon Web Services and Microsoft’s Azure servers, which are located in the United States. Therefore, if you reside outside of the U.S. and use our website, and wish to be provided with Shyft services, your personal data will be transferred outside of your home country.
Since the United States has not received a finding of “adequacy” from the European Union under Article 45 of the General Data Protection Regulation (“GDPR”), Shyft relies on derogations for specific transfer situations, as set forth in Article 49 of the GDPR. In particular, Shyft collects and transfers to the U.S. personal data only: with your consent; to perform a contract with you; or to fulfill Shyft’s compelling legitimate interest in a manner that does not outweigh your rights and freedoms.

We may have to charge you some reasonable administrative fees related to the provision of your personal data. In addition, when technically feasible and upon your request, Shyft will transmit your personal data directly to another controller.
You may also request information about who else outside Shyft might have received the data. You have a right to correct (rectify) the record of your personal data maintained by Shyft, if it is inaccurate. You may request that Shyft erases that data or ceases processing it, subject to certain exceptions. You may also request that Shyft ceases using your personal data for direct marketing purposes. In many countries, you have a right to lodge a complaint with the appropriate data protection authority if you have concerns about how Shyft processes your personal data.
As is true of most other websites, Shyft’s website collects certain information automatically and stores it in log files. The information may include internet protocol (IP) addresses, the region or general location where your computer or device is accessing the internet, browser type, operating system and other usage information about the use of the Shyft’s website, including a history of the pages you view. We use this information to help us design our site to better suit our users’ needs. Shyft has certified to the Department of Commerce that it adheres to the Privacy Shield Principles, and such certification also covers its 100% owned subsidiary Move Genius, LLC. If there is any conflict between the terms in this privacy policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern.
